By choosing to use a child car seat provided by a Pronto Rides driver, you implicitly accept the following terms and conditions. Please read them carefully as they pertain to your legal rights and responsibilities when using our car seat services.
Acceptance of Risk: By using a child car seat provided by Pronto Rides, you acknowledge and assume all risks associated with its use and any related activities. This includes, but is not limited to, risks arising from negligence or carelessness by Pronto Rides or any associated entities, as well as risks from defective equipment or improper installation.
Certification of Installation: You certify that you are sufficiently knowledgeable and adequately trained in the installation of the car seat in a Pronto Rides vehicle. You are responsible for ensuring the car seat is correctly installed and used according to the manufacturer's instructions and safety guidelines.
Car Seat Inspection: All Pronto Rides drivers are required to have their car seats inspected by a Texas recommended agency. This ensures that the car seats and vehicles meet the safety standards required by the state of Texas, providing an additional layer of safety for your child.
Waiver of Liability: You waive, release, and discharge Pronto Rides, its affiliates, officers, employees, and agents from any and all liability for personal injury, death, property damage, or any other damages that may occur while using the child car seat. This includes liability arising from negligence or fault of the aforementioned entities or individuals.
Indemnity Agreement and Promise Not to Sue: You agree to indemnify, hold harmless, and promise not to sue Pronto Rides and its affiliates from any claims or liabilities resulting from the use of the child car seat, whether caused by negligence or otherwise.
Understanding of Risks: You acknowledge that using a child car seat in a vehicle involves inherent risks, including but not limited to risks from motor vehicle accidents, which can result in death, serious injury, and property loss. These risks are present for both passengers and occupants of the car seat.
Broad Interpretation: This waiver and release of liability shall be interpreted broadly to ensure maximum protection for Pronto Rides under applicable law.
Acceptance and Compliance: By using a child car seat provided by Pronto Rides, you affirm that you have read, understood, and agreed to this waiver and disclaimer. This agreement is binding and applies to you and any minors in your care using the car seat.
